Online Lay-by Terms and Conditions
1. Lay-By Process:
1.1 To initiate a lay-by, a 40% deposit of the order’s value is required.
1.2 The deposit will be credited towards the full payment upon completion of the order.
2. Stock Reservation:
2.1 Bamboo Mattresses do not reserve stock for lay-bys.
2.2 In case of unavailability, we will make efforts to source the stock or provide a suitable replacement of similar value.
3. Delivery:
3.1 Free delivery is not applicable to lay-bys.
3.2 We aim to deliver promptly after receiving the full purchase price, but delays due to unforeseen circumstances (“force majeure”) may occur.
3.3 We are not liable for losses arising from such delays, and we will resume performance once possible.
3.4 Alternative delivery dates may be arranged, ensuring they are reasonable and agreed upon with you.
3.5 Goods are identified by type, not reserved during the lay-by. Delivery occurs after receiving the full purchase price.
3.6 If we can’t deliver the specified goods, you may choose an equivalent substitute or receive a refund with interest as per the Prescribed Rate of Interest Act 55 of 1975.
3.7 Providing the correct delivery address is your responsibility.
4. Transfer of Rights:
4.1 Without our written consent, you cannot cede, delegate, assign, or transfer your rights or obligations under this agreement.
4.2 We reserve the right to cede or transfer our rights or obligations to a third party without prior notification.
By entering into this lay-by agreement, you agree to abide by these terms and conditions.
